California AB 1916 on disposal of tenant goods Approved, Effective 2025

Governor Gavin Newsom has approved California Assembly Bill 1916. The bill, which addresses the right of a storage owner to dispose of a tenant’s goods after the termination of the tenant’s lease, will go into effect January 1, 2025.

 

According to Scott Zucker, a partner in the law firm of Weissmann Zucker Euster + Katz P.C. in Atlanta, Ga., the bill specifically includes a “Notice of Right to Reclaim Abandoned Property” that is to be sent to the tenant after the lease has ended. If the tenant doesn’t reclaim the goods and the value is over $300.00, the items can be sold (after publication). If the goods have a value under $300.00, they can be disposed of.

 

The law also addresses an operator’s right to update its leases after 30 days written notice.
